2. Scope
These terms govern purchases made at MotoDirecta’s premises and distance purchases agreed by telephone, WhatsApp or through the website. The customer accepts them when the purchase is concluded.
3. How to buy
The website does not take automatic payment. The process is:
- Select a motorcycle from the catalogue.
- Contact us to confirm availability, final price and vehicle details.
- A motorcycle may be reserved against a deposit, for which a receipt is provided.
- The sale is completed by an agreement signed by both parties.
4. Prices
Prices are in euros and include applicable taxes. Used motorcycles may be sold under Spain’s special second-hand goods VAT scheme (REBU). Where MotoDirecta only manages a commission sale, the owner sells to the buyer and the advertisement identifies that arrangement. Intermediation services are subject to ordinary VAT. Catalogue information is indicative under the Legal Notice; transfer and delivery costs are shown separately where applicable.
5. Payment
- Bank transfer to the account supplied for the transaction.
- Cash within the limits imposed by Spanish law.
- Finance, subject to lender approval. See motorcycle finance.
6. Collection and delivery
- Free collection from our premises in Elche (Alicante).
- Home delivery within Spain for €190. Timing is indicative and agreed with the customer.
Transfer of ownership is handled as agreed in the purchase contract.
7. Warranty
Motorcycles include a 12-month warranty except where the vehicle page expressly identifies an intermediary sale between private individuals. See Warranty and returns for coverage and exclusions.
8. Withdrawal and returns
Distance purchases carry a 14-calendar-day withdrawal right. There is no statutory change-of-mind withdrawal right for a purchase completed at the premises. The process and model form appear in Warranty and returns.
9. Contract language and retention
The binding purchase agreement is completed in Spanish and a signed copy is provided to the customer. MotoDirecta retains it for the periods required by Spanish commercial and tax law.
10. Law and complaints
Spanish law applies and consumer disputes are heard by the courts of the consumer’s domicile. Official complaint forms are available. Consumers may also approach the relevant consumer arbitration board or municipal consumer information office (OMIC).
